GENERAL TERMS AND CONDITIONS

§ 1 Scope

The following General Terms and Conditions (GTC) apply to all purchase contracts concluded via our webshop under the domain "www.cuteycute.de". The contractual partner is:

§ 2 Subject Matter of the Contract

The goods listed in our webshop represent a non-binding product catalog.

§ 3 Conclusion of the Contract

The customer can place items from our product catalog in their shopping cart by clicking the "Add to Cart" button, provided the item is in stock. By clicking the "Order with Payment Obligation" button, the customer makes a binding offer to purchase the goods in the shopping cart. The order confirmation and acceptance of the order take place automatically via email immediately after the shopping cart is sent. The purchase contract for the goods is concluded with this order confirmation.

Before clicking the "Order with Payment Obligation" button, the customer can review the contents of the shopping cart and the personal data provided and make changes at any time by selecting the respective order step and correcting input errors.

§ 4 Prices and Payment

The prices we indicate are gross prices, including all statutory price components, including the applicable VAT, plus shipping costs. The shipping costs can be found under the menu item "Shipping". The specific shipping costs will be displayed to the customer before the order process is completed.

The following payment methods are available: PayPal, advance payment (bank transfer), and payment with Credit Cards.

§ 5 Right of Withdrawal

Customers who are also consumers have a statutory right of withdrawal in distance contracts. Consumers are natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business, or profession. Information on the right of withdrawal, in particular on conditions, deadlines, and procedures for exercising the right of withdrawal, as well as a model withdrawal form, can be found under the menu item "Right of Withdrawal". The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery. Opened and used cosmetics cannot be returned for hygienic reasons if their usual application involves direct contact with the body, such as lipsticks. The customer should therefore consider whether they wish to keep the product before using it.

§ 6 Shipping

The goods we offer will be shipped within 3-8 working days after payment has been received.

§ 7 Warranty

The customer's warranty rights are governed by statutory provisions. Please refer to Returns.

§ 8 Disclaimer of Liability

Claims for damages by the customer are excluded unless they are based on damages resulting from injury to life, body, or health, or on liability for other damages caused by an intentional or grossly negligent breach of duty by us or our vicarious agents. The liability for the violation of obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the customer regularly relies, remains unaffected. In the event of the slightly negligent breach of these contractual obligations, we shall only be liable for foreseeable, contract-typical damage, unless it concerns claims for damages resulting from injury to life, body, or health.

§ 9 Retention of Title, Set-off

If the customer is a consumer, we retain ownership of the goods until full payment of the purchase price. If the customer is an entrepreneur acting in the course of their business or independent professional activity, a legal entity under public law, or a special fund under public law, we retain ownership of the goods until all outstanding claims from the business relationship with the buyer have been settled. The corresponding security rights are transferable to third parties.

The customer is only entitled to set off if the counterclaims have been legally established, are undisputed, or have been acknowledged by us and are based on the same contractual relationship.

§ 10 Storage of Contract Text

We store the contract text and the data necessary for processing the purchase contract. No unauthorized transfer to third parties occurs. The data will be deleted after the transaction is completed and after the expiration of the statutory warranty period. The customer can inquire at any time and via any communication method whether and which data we have stored.
